Illinois eviction proceedings are governed by a strict statutory process. Notice must be given in the correct form and for the correct period, the complaint must be pleaded properly, and possession is decided on a compressed schedule. A defect anywhere in that chain can restart the case from the beginning.
We represent both property owners seeking possession and tenants defending against it.
For property owners
- Preparing and serving statutory notices
- Filing and prosecuting eviction actions
- Claims for unpaid rent and property damage
- Enforcing orders of possession
- Lease drafting and review to avoid future disputes
For tenants
- Defending possession actions
- Improper notice and procedural defenses
- Habitability and repair disputes
- Security deposit claims
- Negotiated move-out agreements
Chicago ordinances
Properties within Chicago are additionally governed by the Residential Landlord and Tenant Ordinance, which imposes requirements beyond state law and provides remedies to tenants where those requirements are not met. Cook County has its own ordinance as well. Which rules apply depends on the property, and it materially changes the analysis.
